New York State SDVOB participation
New York's Service-Disabled Veteran-Owned Business Act, signed May 12, 2014, set a statewide goal of 6 percent participation by certified SDVOBs on state contracts. The law now sits in Article 3 of the New York State Veterans' Services Law. The Office of General Services' Division of Service-Disabled Veterans' Business Development certifies SDVOBs and publishes the directory of certified firms.
The goals reach beyond state agencies: the law also covers state authorities and public benefit corporations, and applies to contracts over $100,000 for the construction, major repair or renovation of real property. Contracting agencies set goals on individual contracts, and bidders typically submit an SDVOB utilization plan with the bid — with documented good-faith efforts where they can't meet the goal. Some state financial assistance programs, such as the Environmental Facilities Corporation's, carry SDVOB goals through to municipal construction contracts.
Only firms certified by OGS count toward a goal, and the SDVOB has to perform a commercially useful function — a distinct element of the work that it actually performs, manages and supervises. How much of a subcontract counts depends on the contracting agency's rules; on NYSDOT contracts, 100 percent of the value of the work an SDVOB subcontractor performs is counted, within the work categories the firm is certified for.
